OPS Breaking: Supreme Court Upholds Pension Rights of PSEB Employees; Pre-Regularisation Contract Service to Count for Pension<\/strong><\/p>\nNew Delhi \/ Sahibzada Ajit Singh Nagar, September 25, 2026: In a significant judgment, the Supreme Court has dismissed an appeal filed by the Punjab School Education Board (PSEB), upholding the rights of its employees to pension benefits.<\/p>\n
The court has clarified that service rendered by employees on a contractual, ad-hoc or daily-wage basis before their regularisation will be treated as \u201cqualifying service\u201d for the purpose of pension. The ruling is expected to provide major relief to hundreds of PSEB employees who had been involved in a prolonged legal battle over their pension rights.<\/p>\n
A bench comprising Justice Prashant Kumar Mishra and Justice Chandrashekhar upheld the decisions of the lower courts as well as the Punjab and Haryana High Court.<\/p>\n
According to the case details, the employees had been working with the Board on temporary, contractual and ad-hoc terms since the 1990s. After serving for several years, their services were regularised in August 2004.<\/p>\n
The Education Board had argued before the court that since the employees were regularised after January 1, 2004, they should be covered under the new Defined Contributory Pension Scheme. The Board also contended that there were certain interruptions in their earlier temporary service and, therefore, that period could not be counted along with their regular service for pension purposes.<\/p>\n
The Supreme Court, however, rejected these arguments. The court observed that the breaks in service were administrative in nature and that the employees could not be held responsible for such interruptions. It also noted that the employees had entered government service well before January 1, 2004.<\/p>\n
The court held that merely because their services were formally regularised in August 2004, their earlier period of service could not be ignored while determining their pension eligibility.<\/p>\n
The judgment further establishes that the employees are entitled to opt for the General Provident Fund (GPF)\/Old Pension Scheme instead of being compulsorily placed under the new contributory pension system. The employees will be given the option to choose between the Old Pension Scheme and the Defined Contributory Pension Scheme, as applicable under the court’s directions.<\/p>\n
The judgment has brought relief and considerable satisfaction among PSEB employees who had been facing uncertainty regarding their retirement benefits and pension for years.<\/p>\n
Legal observers have described the ruling as significant for employees whose services were initially rendered on a temporary, contractual, ad-hoc or daily-wage basis before regularisation. The judgment may also have implications for similar pension-related disputes involving employees in other government departments, depending on the facts and applicable service rules of each case.<\/p>\n
